This got us playing devil's advocate, how would we create a shortage? Firstly, we'd cut the reimbursement price of a commonly used generic product to a fraction of its former value. That would do the trick quite nicely, provided it was done quickly. It might help if this price cut happened just before the CPHI conference which last year was in late October in Barcelona. This would give manufacturers a chance to take the product off their requirements list and for contract manufacturers to remove it from theirs. Then make another even more drastic cut to the reimbursement price shortly after the conference to make sure that any foolishly optimistic manufacturers took it off their lists and incurred legal costs at the same time.

This is intended to keep a cap on the growth in the medicines bill whilst allowing manufacturers to make sufficient profits to keep them supplying the NHS. Previous schemes have included PPRS (prescription price regulatory scheme) which ran until the end of 2013 and VPAS (voluntary scheme for branded medicines pricing and access) which ran from 2014 till the end of 2023. These were both voluntary, but there are and were statutory schemes which manufacturers are entered into if they do not wish to join a voluntary scheme. For the 2024 to 2028 VPAG scheme, medicines are classed as older if there is now more than 12 years since the first marketing authorisation for the active substance. These older medicines have two rebates. The first is the 10% basic rebate, and the second is the % top-up which can be up to 25%. Therefore ‘older medicines’ includes both the originator and follow-on branded generic medicines.

The number of generic concessions granted each month has risen to nearly 200 whilst the number of SSPs is approaching 20. This is the situation at present….. However, there is a threat that shortages might get much worse. This is driven by the voluntary scheme for branded medicines pricing and access (VPAS) and by the rebates paid back by manufacturers of branded and branded generic drugs as part of this scheme. Previous analyses by Wavedata have suggested that 22% of branded medicines and 49% of branded generics do not have sufficient profitability to survive the high rebates and are likely to be removed from sale in the UK.

Additionally we have noticed that products likely to be granted concessions have very narrow pharmacy profit margins. This makes sense since it is the PSNC, representing pharmacies, which negotiates concession with the department of health DHSC. However, this increasing trend highlights a serious problem with the way these products are reimbursed. This is done using the drug tariff, and in order to supply good value for tax payers some products have their tariff squeezed as much as possible. This may be great for tax payers in the short term, but it’s not great for pharmacies, wholesalers and manufacturers. Pharmacies struggle to make a profit, despite the concession, as often it’s not high enough and they spend inordinate amounts of time chasing shortages.

After Viatris' round table on branded generics at the Palace of Westminster earlier this month we decided to investigate this, in the expectation of seeing a lower profitability for concession products. So we divided all the generics we have market prices for into two groups, those which had received concessions and those which had not, and compared the profitability of each. We used the English drug tariff and the average market price rather than the concession price to calculate the normal monthly profit, as we wanted to see if the drug tariff was at fault in some way. We expected to see a graph showing that non-concession products were more profitable than the concession products, and supposed that the graph of profit over time would feature two lines. The higher would be the non-concession products with a higher profit, and the lower would be the concession NCSO products with less profit. This might have told us that the drug tariff pricing for concession products was too aggressive and should be relaxed.
